Source Sportswear – Cancellation Policy

Source Sportswear is committed to compliance with the Consumer Protection Act, 68 of 2008
(CPA) and the Electronic Communications and Transactions Act, 25 of 2002 (ECTA). This Policy
explains your rights and obligations when cancelling an Order placed on our Website.
1. Definitions and Interpretation
“Business Day” means any day other than a Saturday, Sunday, or official public holiday in South Africa.
“Cooling-Off Period” means the 7 Business Day cancellation right for electronic transactions under section 44 of ECTA.
“Order” means a confirmed purchase of Products through the Source Sportswear Website.
“Products” means all sportswear, apparel, footwear, and accessories offered for sale by Source Sportswear.
“Website” means the Source Sportswear online store.
Interpretation: headings are for convenience only; words in the singular include the plural; “including” means “including without limitation”; statutory references include amendments and re-enactments.
2. Cooling-Off Period (ECTA)
If you are a consumer as defined in ECTA, you may cancel an electronic transaction without penalty and without reason within the Cooling-Off Period of 7 Business Days from the date of delivery.
Where a cancellation is made under this clause:
• You must notify Source Sportswear in writing at info@sourcesportswear.com.
• You must return the Products in their original, unused condition with packaging intact.
• Refunds will be made in the form of a store voucher, unless a cash refund is required by a competent Authority (court or Information Regulator).
3. Cancellations Prior to Shipment
You may cancel an Order at any time before shipment has been confirmed.
If payment has already been processed, Source Sportswear will issue a store voucher for the full value of the Order.
4. Cancellations After Shipment
Once Products have shipped, cancellations will be treated as a return and are subject to the Returns & Exchanges Policy.
Shipping costs already incurred are non-refundable
5. Failed Delivery and Uncollected Orders
If delivery cannot be completed due to incorrect address, repeated failed attempts, or uncollected parcels, the Products will be returned to Source Sportswear.
In such cases:
• You remain liable for all courier costs (including return and reshipment fees).
• A restocking fee of up to 15% of the Order value may be charged.
• Reshipment will only occur once outstanding fees are settled.
6. Refunds
Source Sportswear does not generally issue cash refunds.
All refunds will be settled by exchange or store voucher valid for 12 months.
A cash refund will only be made if legally required by a relevant Authority.
7. Force Majeure
Source Sportswear will not be liable for any delay or failure to perform obligations under this Policy due to events beyond its reasonable control, including strikes, riots, power outages, or courier disruptions.
8. Governing Law and Jurisdiction
This Policy is governed by the laws of the Republic of South Africa. Any dispute shall be resolved in accordance with clause 16 of the Terms & Conditions (Dispute Resolution).
9. Entire Agreement
This Cancellation Policy must be read together with the Terms & Conditions and Returns & Exchanges Policy. Together, they set out the full rights and obligations of both parties regarding cancellations.
